Cross Compliance Penalties

Each year the RPA publish data on the number of penalties given for breaches of Cross Compliance standards.

Cross compliance includes both Statutory Management Requirement standards (SMRs) and Good Agricultural and Environmental Conditions Standards (GAECs), which must be followed if claiming BPS, Environmental Stewardship or Countryside Stewardship.  Penalties will be given to those not meeting Cross Compliance standards.

Temporary field heaps have been positioned in single position for more than 12 months

GAEC 7: Boundaries

 

Applying pesticide, fertiliser or cultivating with in 1 or 2 metre protection zone

Not taking reasonable steps to maintain green cover on the 2 metre protection zone throughout the year

Trimming hedges between 1st March and 31st August

GAEC 7b: Public rights of way

Visible public right of way has been wilfully obstructed

SMR 7: Cattle ID and registration

Movements not reported or reported incorrectly

Death of animal not reported

Incorrect date recorded

Ear tags lost for 28 days or more

Animal not found in farm records

SMR 8: Sheep and goats ID

Missing records for movements, ID, deaths and replacement tags

Missing stocktake (inventory) for stock on holding

SMR 11: Welfare of calves

 

Cleaning and disinfection procedures inadequate

Faeces, urine, uneaten or spilt food not been removed frequently enough

Calves do not have access to clean, comfortable, well drained lying area

The Rural Payments Agency (RPA) and Animal and Plant Health Agency (APHA) carry out Cross Compliance visits on a selection of holdings each year, most giving just 48 hours’ notice of visit.
